Terms of Service

Effective date: June 6, 2026

These Terms of Service ("Terms") govern your access to and use of RigBuddy ("RigBuddy", "we", "us"), including our mobile app, web portals, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of a company, you represent that you are authorized to bind that company.

1. The Service

RigBuddy is a software tool that helps trucking fleets perform driver vehicle inspections (DVIRs), capture photos, review and approve inspections, and generate inspection reports. RigBuddy is a recordkeeping and workflow tool. It is not a law firm, a compliance consultancy, or a substitute for your own legal and regulatory obligations.

3. Your responsibility for compliance

You are solely responsible for complying with all applicable laws and regulations, including U.S. Department of Transportation and FMCSA requirements (such as 49 CFR §396.11). You are responsible for ensuring that inspections are actually performed, that defects are addressed, and that vehicles placed out of service are not operated. RigBuddy helps you record and organize this work, but the responsibility for performing it and for the condition of your vehicles remains yours.

4. AI features are advisory only

RigBuddy may use automated and AI tools to analyze inspection photos and suggest possible defects. These outputs are advisory only, may be incomplete or inaccurate, and are not a determination of a vehicle's condition or roadworthiness. A qualified person must make the final inspection decision. You must not rely on AI output as a substitute for a proper inspection.

6. Fees and billing

Paid plans are billed per active truck, per month. You can add or deactivate trucks at any time; your charges follow the number of active trucks. Fees are non-refundable except where required by law. If an account is not paid, we may suspend access after notice; your inspection records are retained and remain available for export during any suspension.

7. Your data

Your inspection data, photos and reports belong to you. We process them to provide the Service as described in our Privacy Policy. We keep DVIR records and related data to support your recordkeeping and audit needs; you can request export or deletion as described in the Privacy Policy.

8. Availability

We work to keep the Service available and reliable, but we provide it "as is" and do not guarantee uninterrupted or error-free operation.

9. Disclaimers

To the maximum extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that use of the Service will ensure regulatory compliance or prevent citations, out-of-service orders, accidents, or penalties.

10. Limitation of liability

To the maximum extent permitted by law, RigBuddy and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or compliance penalties. Our total liability for any claim relating to the Service will not exceed the amounts you paid to us for the Service in the three (3) months before the claim.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms or non-payment. On termination, you may request an export of your records.

12. Changes

We may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Continued use of the Service after changes means you accept the updated Terms.
